Serious Advocacy In Tough Cases

Could you face charges for prescription drugs?

On Behalf of | Apr 21, 2026 | Drug Crimes

It is not illegal to own or use prescription drugs. They are a controlled substance, however, which is why you need to get a prescription to pick them up at the pharmacy in the first place.

As such, it is important to consider a few of the different ways you could find yourself facing legal charges for prescription drugs. These often feel much different than patently illegal substances, so you do not want to accidentally violate the law.

Sharing prescriptions

For example, it is federally illegal to share prescription medications with someone else. People often do this with the best of intentions. They just want to help a family member or a friend. But doing so violates federal and state laws, and the other person could also face charges for illegal drug possession.

Selling prescription medication

Similarly, you certainly cannot sell prescription drugs. Even if you did not technically use all of the medication that you received, you need to appropriately dispose of it, rather than selling it. This is especially an issue with opioids, which are often used recreationally, so resale is strictly prohibited.

Driving a vehicle

Finally, we recently discussed how prescription drugs may lead to impaired driving charges. It is very important to read the documentation that comes along with the medication. If it says you should not operate heavy machinery, then you should not drive your car.

Your defense options

Mistakes with prescription drugs can sometimes lead to serious and unexpected criminal charges. If you find yourself in this position, be sure you know what defense options you have.
